Dear friends and colleagues,

As you know, since 2003 litigation regarding use of third parties trade marks to trigger sponsored links has lead to jurisprudence which is as abundant as disorientating.

Five series of requests for preliminary rulings were passed to the European Court of Justice. The first of these decisions is expected on 23 March 2010. While this decision will certainly not be the end to all AdWords disputes, the interpretation of the Trade Marks and Electronic Commerce Directives expected from the highest European Court is highly anticipated.

Three French blogs will release a podcast commenting the decision, just a day after it has been released (should no technical difficulties arise).
